Right to Refuse Service

We reserve the right to refuse service, cancel orders, suspend accounts, or terminate access to our services at our sole discretion where reasonably necessary to protect our business, intellectual property, customers, community, or platform.

2. Intellectual Property, Copyright & Use Restrictions

All course content, including but not limited to videos, audio recordings, demonstrations, text, graphics, downloadable materials, images, lesson structures, teaching methods, and supporting resources, remains the exclusive intellectual property of David Malinowski and/or Makeup-Effects Limited and is protected by applicable copyright, trademark, and intellectual property laws.

Personal Licence Only

Your purchase grants you a limited, non-exclusive, non-transferable licence to access the course for your own personal educational use.

You may not:

  • Copy, reproduce, distribute, share, publish, or republish course materials.
  • Download, record, screen capture, rip, archive, or store course content.
  • Publicly display or broadcast course content.
  • Modify or create derivative works from course materials.
  • Share access with any third party.

Use of Name, Image & Likeness

You may not use David Malinowski’s name, image, likeness, photographs, screen captures, video footage, testimonials, or branding for commercial, promotional, marketing, or endorsement purposes without prior written consent.

No Certification or Endorsement

Completion of this course does not constitute certification, accreditation, qualification, licensing, endorsement, or approval by David Malinowski or Makeup-Effects Limited. You may not represent otherwise.

Commercial Re-Teaching Restriction

You may not reproduce, republish, adapt, substantially replicate, or commercially exploit the structure, presentation, demonstrations, proprietary teaching methods, instructional content, or educational materials contained within this course for educational or training purposes without prior written consent.

Artificial Intelligence Restriction

Course content may not be used, in whole or in part, to train, develop, improve, support, or contribute to any artificial intelligence system, machine learning model, automated knowledge base, generative AI platform, or similar technology without prior written permission.

3. Account Security, Access & Conduct

Single-User Licence

Course access is licensed to a single individual only. Your login credentials must remain confidential and may not be shared with any other person.

Simultaneous logins, credential sharing, account lending, or any attempt to provide access to third parties is strictly prohibited.

Monitoring & Investigation

We reserve the right to monitor account activity and investigate suspected account sharing, unauthorised access, or breaches of these Terms. We may temporarily suspend access while such investigations are carried out.

Account Termination

Where we reasonably determine that account sharing, unauthorised distribution, piracy, fraud, or other serious breaches have occurred, access may be terminated immediately without refund.

Community Conduct

If community areas, comments sections, forums, live sessions, or similar features are provided, you agree to conduct yourself respectfully and professionally.

We reserve the right to remove content, restrict participation, or terminate access without refund where users engage in harassment, abusive behaviour, spam, discrimination, unlawful conduct, or unauthorised self-promotion.

Technology Disclaimer

4. Refunds, Pricing & Course Access

You acknowledge that once access has been granted, you may lose any statutory right to cancel or withdraw from the purchase where such rights are waived under applicable consumer protection legislation.

Refund Policy

Due to the digital nature of the course and the immediate delivery of proprietary educational content, all sales are final. No refunds, exchanges, or partial refunds will be issued once access has been granted. Any exception shall remain entirely at our sole discretion.

Unlimited Access

“Unlimited Access” means access for as long as this course remains available and supported on our platform. We intend to provide access for the foreseeable future; however, we reserve the right to retire, discontinue, replace, modify, or remove any course, service, or platform at any time.

Should we permanently discontinue the course, we will endeavour to provide at least thirty (30) days’ notice via the email address associated with your account. Following closure of the course or platform, our obligations regarding ongoing access shall cease.

Course Updates & Future Content

We may update, modify, add, remove, replace, or improve course content, bonus materials, downloadable resources, live sessions, supplementary materials, or platform features at any time. Future updates, additions, or bonus content are not guaranteed unless expressly stated at the time of purchase.

Non-Transferability

Course access may not be sold, assigned, sublicensed, transferred, gifted, or otherwise provided to any third party without our prior written consent.

Billing & Invoicing

All payments are processed by Makeup-Effects Limited. Charges appearing on your payment statement may reference Makeup-Effects Limited rather than davidmalinowski.com.

Pricing, Fees & Taxes

All prices are subject to change without notice. You agree to pay the total amount displayed at checkout, including any applicable VAT, sales taxes, duties, transaction fees, or other legally required charges based upon your location.

5. Health & Safety Acknowledgement

You acknowledge that silicone painting may involve the use of professional materials, chemicals, solvents, pigments, airbrush equipment, compressed air systems, adhesives, and related products.

Safety Requirements

You are solely responsible for ensuring that you work in a safe environment and comply with all applicable safety recommendations, product instructions, and manufacturer guidance. Appropriate ventilation, extraction systems, respirators, gloves, eye protection, and other suitable Personal Protective Equipment (PPE) should be used wherever necessary.

Results Disclaimer

Individual results will vary. We make no guarantees regarding artistic outcomes, technical performance, commercial success, material compatibility, or product performance.

Third-Party Products

Any references to products, suppliers, manufacturers, brands, or materials are provided solely for educational purposes. We accept no responsibility for the quality, suitability, safety, availability, or performance of third-party products.

Assumption of Risk

You undertake all practical work demonstrated within the course entirely at your own risk. You assume full responsibility for any injury, illness, allergic reaction, property damage, financial loss, or other consequences arising from the use of materials, equipment, products, or techniques discussed within the course.

6. Limitation of Liability & Legal Matters

Limitation of Liability

To the fullest extent permitted by law, our total liability arising from or relating to your purchase, access, or use of the course shall not exceed the amount paid by you for the course.

Excluded Liability

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation.
  • Any liability that cannot legally be excluded or limited under applicable law.

Indemnification

Force Majeure

We shall not be liable for any delay, interruption, or failure to perform our obligations where such failure results from events beyond our reasonable control.

Claim Limitation Period

Any claim arising from these Terms or your use of the course must be commenced within one (1) year of the event giving rise to the claim.

Governing Law
